Summary:

President Joseph R. Biden Jr. has directed the United States Trade Representative to maintain and modify the ad valorem rates of duty and lists of products subject to the statutory 4-year review of the Section 301 investigation of China’s Acts, Policies, and Practices Related to Technology Transfer, Intellectual Property, and Innovation. The review found that while tariffs have been effective in encouraging China to address certain issues, China has not eliminated many of the technology transfer-related acts, policies, and practices at issue. As a result, the Trade Representative will increase section 301 ad valorem rates of duty for certain products from China, including battery parts, electric vehicles, lithium-ion electrical vehicle batteries, and other critical minerals. Additionally, the Trade Representative will increase rates of duty for personal protective equipment such as facemasks, medical gloves, and syringes and needles. The Trade Representative will also establish a process for interested persons to request temporary exclusions from section 301 tariffs for certain machinery used in domestic manufacturing. President Biden has authorized and directed the Trade Representative to publish this memorandum in the Federal Register.
